1. Agreement
By creating an account, signing in, or using VistaWatch ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
VistaWatch is a video hosting platform that lets you upload, publish, watch, comment on, and share videos. Features may change over time. We may modify, suspend, or discontinue parts of the Service with or without notice.
3. Accounts
You must provide a valid email address and keep your account information accurate. You are responsible for activity under your account. Sign-in uses one-time email links; protect access to your inbox. You must be old enough to form a binding contract in your jurisdiction (and at least 13 years old, or the higher age required where you live).
4. Your content
You retain ownership of videos, thumbnails, titles, descriptions, comments, and other material you submit ("Your Content"). You grant VistaWatch a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for format/transcoding), display, and distribute Your Content solely to operate and improve the Service. You represent that you have all rights needed to upload and publish Your Content and that it does not infringe others' rights.
5. Acceptable use
You may not use VistaWatch to upload or share content that is illegal, that exploits or endangers minors, that promotes violent crime or terrorism, that is non-consensual intimate imagery, that infringes copyright or other IP, that contains malware, or that harasses or threatens others. You may not abuse the Service (spam, scraping beyond normal use, circumventing limits, inflating views or reactions, or attempting to access others' accounts or data).
6. Moderation and removal
We may remove content, restrict visibility, suspend accounts, or terminate access when we believe these Terms or applicable law have been violated, or when needed to protect the Service or other users. We are not obligated to monitor all content.
7. Intellectual property
The VistaWatch name, branding, site design, and software (excluding Your Content) are owned by us or our licensors. You may not copy or reuse them except as allowed by these Terms or with written permission.
8. Privacy
We process account data, usage data, and uploaded media to provide the Service (authentication, hosting, delivery, abuse prevention, and product improvement). Do not upload personal data about others without a lawful basis to do so.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that content will be preserved without loss.
10. Limitation of liability
To the fullest extent permitted by law, VistaWatch and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of (a) amounts you paid us for the Service in the twelve months before the claim, or (b) one hundred US dollars (or local equivalent).
11. Changes
We may update these Terms. The "Last updated" date will change when we do. Continued use after changes become effective constitutes acceptance. If a change is material, we will try to provide reasonable notice (for example via the site or email).
